    Dak Prescott’s Lawyer Issues Statement After Sexual Assault Suit Dismissed by Judge

    Dak Prescott's lawyer issued a statement after a Texas judge dismissed a sexual assault lawsuit brought against the Dallas Cowboys quarterback.

    Dak Prescott scored a legal victory on Wednesday.

    Texas Judge Angela Tucker dismissed a sexual assault lawsuit brought against the Dallas Cowboys quarterback earlier this year. The accuser, Victoria Shores, claimed Prescott committed sexual assault against her seven years ago.

    Prescott’s attorney, Levi McCathern, issued a statement shortly after the suit was dismissed.

    “Despite Ms. Shores and her legal team’s relentless efforts to extort money and damage Dak’s reputation, justice has consistently prevailed and will continue to do so,” McCathern said. “The original lies by Ms. Shores, her team, and their recent failed attempt to sue him civilly are all just a continuation of their extortion plot against Dak.

    “These ploys distract from the trauma of legitimate sexual assault survivors and undermine the progress that our society has made in supporting them. We are proud that Dak stands up against this injustice and thankful Judge Tucker agrees.”

    In the same press release, Prescott’s lawyer said the judge determined the claims “lacked merit and should be dismissed immediately.” However, it’s unclear whether the case was dismissed due to procedural issues or the claims being considered frivolous.

    Here’s an explanation from ProFootballTalk’s Mike Florio, who previously worked as a labor attorney:

    “The sexual assault claim was barred by the applicable statute of limitations,” Florio wrote Thursday.

    “Because Prescott initially sued the accuser for extortion arising from her lawyers’ efforts to settle her allegations out of court, the sexual assault claim was made based on a provision of Texas civil procedure that arguably allows otherwise time-barred claims to be pursued, if they are part of a counterclaim.

    “Yesterday’s ruling quite possibly was confined to the question of whether that exception applies in this case, and not a statement that the allegations of sexual assault is false. … There’s no reason to doubt that the civil claims against Prescott were dismissed. The final order signed by Judge Tucker will say plenty about the reason(s) for dismissing the case.”

    Prescott’s extortion claims against Shores and her attorneys are pending. Per Prescott’s lawyer, Judge Tucker set a hearing for Sept. 13 to determine whether Shores/her team should be sanctioned for making frivolous accusations.
